1. ACCEPTANCE OF TERMS

By accessing the DigiLamp online store and/or placing an order, you (the "Customer") agree to be bound by these Terms of Service (the "Terms"), our Privacy Policy, and our Return & Refund Policy, all of which are incorporated herein by reference. If you do not agree to these Terms in their entirety, you must refrain from using our services.

DigiLamp reserves the right to update or modify these Terms at any time without prior notice. The version published at the time of your purchase will be the version applicable to that transaction. Continued use of our store following any modification constitutes acceptance of the updated Terms.

DigiLamp is an international e-commerce store specializing in decorative and collectible lighting products, including projection lamps and anime-themed merchandise. DigiLamp operates globally and ships worldwide.

 

3. ELIGIBILITY

By placing an order, you represent and warrant that:

• You are at least 18 years of age, or you have obtained verifiable parental or legal guardian consent.
• You have the legal capacity to enter into a binding contract under the laws of your country of residence.
• You are not located in a country subject to a trade embargo or sanctions that would prohibit the purchase or receipt of our products.
• All information you provide during the purchase process is accurate, current, and complete.

 

4. PRODUCTS AND DESCRIPTIONS

DigiLamp makes every reasonable effort to ensure that product descriptions, images, and specifications published on our store are accurate and up to date. However:

• Product images are for illustrative purposes only. Colors, dimensions, and appearance may vary slightly due to photographic lighting, screen resolution, or manufacturing tolerances.
• DigiLamp reserves the right to modify, discontinue, or limit the availability of any product at any time without prior notice.
• In the event of a material discrepancy between the product received and its published description, the customer is entitled to the remedies set forth in our Return & Refund Policy.

 

5. PRICING AND PAYMENT

All prices displayed on the DigiLamp store are in Euros (EUR) unless otherwise specified. Prices include applicable VAT where required by law. International customers are responsible for any customs duties, import taxes, or local charges imposed by their country of destination — these are not included in the purchase price and are not the responsibility of DigiLamp.

DigiLamp accepts payment through the methods available at checkout. By submitting a payment, you authorize DigiLamp to charge the full purchase amount, including applicable shipping costs, to your selected payment method. All transactions are processed through secure, encrypted payment gateways.

DigiLamp reserves the right to cancel any order in the event of a pricing error, fraud suspicion, or payment failure, with full notification to the customer.

 

6. ORDER PROCESSING AND CONFIRMATION

An order placed through our store constitutes an offer to purchase. The contract of sale is formed only upon DigiLamp's issuance of an order confirmation email. DigiLamp reserves the right to refuse or cancel any order at its sole discretion, including but not limited to cases of:

• Product unavailability or stock errors.
• Suspicion of fraudulent activity.
• Errors in pricing or product information.
• Inability to verify payment authorization.

In the event of order cancellation by DigiLamp, the customer will receive a full refund of any amount paid within 14 business days.

 

7. SHIPPING AND DELIVERY

DigiLamp ships worldwide. Estimated delivery times are provided at checkout and are indicative only. Actual delivery times may vary due to factors outside DigiLamp's control, including customs processing, carrier delays, public holidays, and peak demand periods.

DigiLamp is not responsible for delivery delays caused by:

• Incorrect or incomplete delivery addresses provided by the customer.
• Customs clearance procedures in the destination country.
• Force majeure events, including natural disasters, pandemics, strikes, or government-imposed restrictions.
• Carrier operational issues beyond DigiLamp's control.

Risk of loss and title for products passes to the customer upon delivery to the carrier. DigiLamp strongly recommends customers track their shipments using the tracking number provided in the shipping confirmation email.

 

Special dates disclaimer: DigiLamp does not guarantee delivery by any particular date, including Christmas, Hanukkah, Valentine's Day, birthdays, anniversaries, or any other occasion of personal significance. Customers are strongly advised to place orders at least 20–30 calendar days in advance for time-sensitive deliveries.

 

8. INTELLECTUAL PROPERTY

All content published on the DigiLamp store, including but not limited to product names, logos, images, descriptions, and graphic elements created by DigiLamp, are the intellectual property of DigiLamp or its licensors and are protected by applicable copyright and trademark laws.

The products sold by DigiLamp may feature characters, imagery, or trademarks belonging to third-party intellectual property owners (e.g., Digimon / Bandai Namco). DigiLamp does not claim ownership of such third-party intellectual property. Any use of third-party trademarks is for descriptive purposes only, and DigiLamp operates as an independent reseller.

Customers may not reproduce, distribute, or commercially exploit any content from the DigiLamp store without prior written consent.

 

9. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, DigiLamp shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages arising from the use of our products or services.
• Loss of profits, loss of data, or business interruption.
• Damages arising from delivery delays, carrier errors, or customs delays.
• Any dissatisfaction with products that conform to their published description.

DigiLamp's total liability to any customer for any claim arising out of or in connection with a purchase shall not exceed the total amount paid by the customer for the relevant order.

Nothing in these Terms limits DigiLamp's liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

 

10. DISCLAIMER OF WARRANTIES

DigiLamp provides its products and services "as is" and "as available", without warranties of any kind, express or implied, beyond those required by mandatory consumer protection law. DigiLamp does not warrant that:

• Products will meet every individual customer's expectations beyond what is described in the product listing.
• The store will be available without interruption or error at all times.

Statutory consumer rights under the applicable law of the customer's country of residence are not affected by this disclaimer.

 

11. PRIVACY AND DATA PROTECTION

12. PROHIBITED USES

When using the DigiLamp store, customers agree not to:

13. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms are governed by and construed in accordance with the laws of Spain. In the event of a dispute, the parties agree to attempt to resolve the matter amicably through direct communication with DigiLamp at digilampp@gmail.com before initiating any formal legal proceedings.

If an amicable resolution cannot be reached, disputes shall be submitted to the exclusive jurisdiction of the Courts and Tribunals of Madrid, Spain, without prejudice to the mandatory consumer protection rights applicable in the customer's country of residence.

14. SEVERABILITY

If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severed from the remaining Terms, which shall continue in full force and effect.

 

15. ENTIRE AGREEMENT

These Terms, together with the Return & Refund Policy and the Privacy Policy, constitute the entire agreement between DigiLamp and the customer with respect to the purchase and use of our products and services, and supersede all prior agreements, representations, or understandings, whether written or oral.
